In submitting a work to one of the challenges you acknowledge that you are creating fan art as a derivative work of the copyrights and trademarks owned by Twentieth Century Fox Film Corp. and/or Madefire, Inc. (“Fox” and “Madefire”) in and to the Planet of the Apes movies, motion books and other associated works (the “POTA Assets”). When submitted to the galleries, Fox and Madefire will license your work to use the POTA Assets only for the purposes of these challenges all as more fully described below.

1. Except for the POTA Assets, all original, non-infringing elements of the Works contributed by a member of DeviantArt (the “Artist”) will remain the exclusive property of the Artist, provided that:

Artist will not acquire any ownership rights or any other rights, title or interests in any names, trademarks, logos, copyrights, characters, elements or any other intellectual property associated with POTA Assets, including without limitation, properties owned, controlled, distributed or developed by Fox and/or any of its licensees or licensors including Madefire. The POTA Assets include without limitation, any Planet of the Apes characters, designs, costumes, devices and/or other elements and any characters, designs, costumes, devices or elements rendered by Artist as part of the Work that use any POTA Assets, the materials provided to the Artist, if any, for the challenges or any other materials owned and/or controlled by Fox and/or Madefire.
3. Except for the purposes of creating a Work for submission to one of the challenges, Artist may not use the POTA Assets without express prior written approval from Fox, which it may grant or deny in its sole discretion;
4. For a period of three years, Works submitted to the challenges may be posted as a part of Planet of the Apes (the “Project”) and otherwise displayed in selections made by DeviantArt and/or Fox and/or Madefire or its affiliated companies in social media applications on or off the DeviantArt site, but only in connection with promotion of the Project and/or with reference to the Project;

Artist may use the Work for the purposes of display in social networks such as DeviantArt or in a personal portfolio but Artist may not authorize or permit any Work to be used to promote any product or service and may not sell the Work or receive any payment whatsoever in connection with the Work. Artist agrees to respond promptly to any request from DeviantArt, Fox and/or Madefire to use the Work other than in the manner set out in paragraph 4, above.
6. Artist may use any aspect of the Work that does not include the POTA Assets in any fashion whatsoever without any restrictions,

Artist acknowledges that Fox and Madefire, their affiliates and/or licensors and licensees have had, may have and will continue to have, numerous other artists and other individuals render artwork based on POTA Assets, and that Fox and Madefire, their affiliates and/or licensors and licensees may freely use any such artwork by other artists without any obligation or liability to Artist whatsoever notwithstanding any coincidental similarity between such artwork and the Work.
8. Artist warrants and represents that his or her contributions to the Work are completely original to the Entrant and will not infringe upon any third party intellectual property rights of any kind in any manner.
9. The last date for submissions to all of the challenges is 12/18/16. Badges for participating in the Project will be awarded 12/23/16.
10. DeviantArt reserves the right to not award a badge level if the submission doesn’t conform to the intention of the challenge.
