  1. SPONSOR:

    "The Wind Rises" Homepage Take Over Contest (the "Contest") is sponsored by deviantART, Inc.

  2. ELIGIBILITY:

    Entrants must be at least eighteen (18) years of age as of February 21, 2014 to be eligible to enter the Contest and a legal resident of Canada, excluding Quebec, or the United States including the District of Columbia and United States military bases wherever located, and a member of deviantart.com in good standing. Employees of the Sponsor and its parent company, subsidiaries, affiliated and successor companies; the advertising, promotional and fulfillment agencies, and any other entity associated with the Contest (individually and collectively, the “Entities”); the members of their households and members of their immediate families, are all ineligible to participate in this Contest. Membership to www.deviantart.com (the "Contest Site") is required to enter the Contest. Membership in deviantART is free. No purchase necessary to enter or win. Members of deviantART are not automatically entered into the Contest. Contest is void where prohibited by law.

  3. HOW TO ENTER:

    • During the Promotion Period, Entrant must follow the instructions on the Contest Site and submit the completed entry of an original arrangement or interpretation artwork based upon the film "The Wind Rises" "(the "Film"), using the information and the elements and images in the asset pack provided on the Contest Site. Each person that submits an entry shall hereinafter be referred to as an "Entrant."
    • The completed original artwork submitted by the Entrant (the "Work") may use combinations from the images provided or reproduce the images into any drawing, painting or digital medium other than photography and be submitted at the Contest Site as a single JPG or PNG file. Photographs of an entry made in another medium are acceptable.
    • The Work:
      • must be approximately 2,000 pixels in width and 550 pixels in height;
      • must be the Entrant's original work made for the Contest and may not use stock materials from others, trademarks, or characters other than those from the Film. The Work must be under no restriction, contractual or otherwise, that will prevent Sponsor and/or the Film Companies’ (defined below) use of the Work and each Work must be free of any and all liens, encumbrances and claims of third parties, with the exception of the limited license provided herein. Entrant acknowledges, agrees, represents and warrants that, nothing in the Work infringes on any copyrights, confidential information, trade secrets or trademarks belonging to any person or entity other than the Entrant or violates any person's rights of privacy or publicity and that all necessary releases and permissions have been secured from anyone’s likeness appearing in the Work or any person or entity with any rights in or to the Work.
      • licensed brushes and textures are acceptable as well as original assets from the Entrant's own work and visual elements from the Film. Do not include the name of the Film or of Hayao Miyazaki in your entry;
      • The Work must be in keeping with the image of Sponsor and the companies involved in the production, distribution, and marketing of the Film (the “Film Companies”) and may not disparage or place Sponsor and/or the Film Companies in a negative light, as determined in Sponsor’s sole discretion. The Work may not be inappropriate, offensive, libelous or defamatory, pornographic, sexually explicit, unlawful or plagiarized, as determined by the Sponsor in its sole discretion; must not be harassing, abusive, threatening, harmful, vulgar, profane, obscene, excessively violent, racially, ethnically or otherwise objectionable or offensive in any way, as determined by Sponsor in its sole discretion; may not violate or encourage others to violate any applicable law, statute, ordinance or regulation; may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights, or involve physical harm to any person or animal; may not contain verbal or visual mentions of commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans, other than those permitted by these Official Rules; may not include any viruses, worms, corrupt files, Trojan horses, or other forms of corruptive code or content that may harm or compromise the Contest Site and/or the proper conduct of the Contest; may not use any watermarks but may contain a signature by the artist provided that the signature is capable of removal at the request of Sponsor if the entry is adapted for use by the Sponsor as a winning entry in accordance with these Official Rules; and, if found to be in violation of these Rules will be disqualified and therefore removed from the Contest Site gallery (the “Gallery”). Works will be added to the Gallery at Sponsor’s discretion.
    • Only online entries will be accepted. No hard copies of the entry will be accepted for judging.
    • Note: The three winning entries will be used in connection with a direct advertisement for the Film placed on deviantART as a home page billboard takeover.
    • ENTRIES MUST BE RECEIVED BY 11:59:59 PM (LOS ANGELES TIME) February 26, 2014 . No illegible, incomplete, forged or altered entries will be accepted. Works will not be returned.
    • Entrants may enter as many Works as they like however duplicate entries are not allowed.
  4. ENTRANT'S RIGHTS:

    • By entering this Contest, Entrant is hereby granted by Film Companies a non-exclusive license to create a derivative work using Film Companies’ copyrighted works (in whole or in part) as required (but only as required, and only for the purpose of creating the Work); provided however, that such license shall be conditioned upon Entrant’s assignment of all rights in and to the Work that Entrant creates, to Film Companies. If such rights are not assigned to Film Companies, Entrant’s license to create derivative works using Film Companies’ copyrighted works (in whole or in part) shall be null and void. Entrant agrees to the foregoing grant of rights, consents, agreements and assignments whether or not Entrant’s Work is used by Film Companies as provided in these Official Rules. Neither Film Companies nor Sponsor will use any original elements found in a Work by Entrant except in connection with the promotion of the Contest or as a winning entry. Notwithstanding the foregoing, Entrant acknowledges and agrees that it is the nature of the Film Companies businesses to create and disseminate works that may be substantially similar to the Work and Entrant will not be entitled to any compensation as a result of Film Companies use of similar works, nor will Entrant seek injunctive or other equitable relief or attempt to in any way enjoin the exploitation or other use of any Film Companies’ works.
      • Entrant will not acquire any ownership or other interest in any and all trademarks, logos copyrights and other intellectual property of the Film Companies including any characters, costumes, devices or other elements and images, or any characters from the Film provided in the Asset Pack or otherwise nor in any costumes, devices, artwork or elements rendered by Entrant as part of the Work that use any copyrighted or trademarked element of materials owned and licensed by the Film Companies (collectively the "Marks");
      • except as expressly required in these Official Rules, Entrant may not use the Marks in any manner whatsoever in connection with the Work or otherwise without Film Companies’ express prior written approval;
      • The three (3) winning entries will be used in connection with a direct advertisement for the Film placed on deviantART as a home page billboard takeover. Entrant specifically consents to this use and understands that the winning Work may be adapted, altered or modified in any fashion for this use, as determined by Sponsor in its sole discretion.
      • Entrant may not authorize or permit any Work to be used to promote any product or service of any party other than the Film Companies and/or Sponsor, may not sell the Work or receive any payment for the use of the Work and may only use the Work for the purposes of display in a personal portfolio or in connection with his or her account on deviantART.com.
      • Entrant acknowledges that the Film Companies have had, and will continue to have, numerous other artists render artwork based on the Film, and that the Film Companies may freely use any such artwork by others without any obligation or liability to Entrant whatsoever notwithstanding any coincidental similarity between such artwork and the Work.
  5. JUDGING CRITERIA AND SELECTION OF WINNERS:

    There will be three (3) winners in the Contest (the "Winners"). The potential winners will be selected on or about February 28, 2014, from all eligible and qualified entries by full-time deviantART staff who are qualified and impartial judges. The Winners will be selected on the basis of (i) effectiveness as a tribute to the Film; (ii) overall impact of the Work; and (iii) originality and artistic skill; all in whatever degree the judges believe to be appropriate in reaching a decision. The judges' decisions are final on all matters relating to the Contest. In the event of a tie , the entry with the highest score in "effectiveness as a tribute to the Film," as determined in the judges sole discretion, will be determined the potential Winner. The Winners will be announced on the Contest Site, one per day, on February 28, March 1, and March 2, in home page billboard takeovers and thereafter in a message center announcement to all Entrants.

  6. PRIZES:

    There are three (3) prizes (each a “Prize”) to be awarded in this Contest, one (1) prize to each winner. Each Prize consists of:

    • One Thousand ($1,000) U.S. dollars;
    • Entrant's winning Work included in a home page billboard takeover on deviantART.com for one (1) day with the Work linked to the Entrant’s deviantART page for the Work and the Entrant’s name linked to his or her profile page on deviantART;
    • A framed print of their winning Work for personal use.

    Total approximate retail value (“ARV”) of each Prize is $1,150 USD and the ARV of all Prizes is $3,450 USD. All Prizes will be awarded (assuming sufficient number of entries). No other substitution or transfer of prizes permitted. Sponsor responsible only for prize delivery; not responsible for prize utility, quality or otherwise. All taxes associated with any Prize awarded are solely the responsibility of each Winner. A Prize cannot be used in conjunction with any other promotion or offer. Prize elements may not be separated. In the event any portion of the Prize cannot be awarded as stated, that portion of the Prize will go unawarded. Costs and expenses associated with Prize acceptance and use not specifically stated herein as being provided are the sole responsibility of the Winners. No interest will be awarded on cash prizes. Prizes are subject to availability, non-transferable, non-negotiable, non-refundable and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute a Prize for one of equal or greater value for any reason. Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the Contest. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

  7. VERIFICATION OF WINNERS AND DELIVERY OF PRIZES:

    In order to be confirmed as a Winner, and without limitation of any other terms herein, the potential winner may be requested to provide satisfactory proof, as determined by Sponsor in its sole discretion, that such potential winner is an eligible Entrant, including but not limited to providing a copy of the potential winner’s government-issued identification and/or additional information required by Sponsor in order to verify eligibility and compliance with these Official Rules. If a potential winner is a resident of Canada, such potential winner will may be required to answer correctly a mathematical skill testing question without assistance of any kind whether mechanical or otherwise to be declared a winner and be eligible to collect the prize. Potential winners may be required to sign an affidavit of eligibility and liability release, a written assignment of the Works, and, where permitted, a publicity release prior to their being declared a Winner (collectively, “Prize Claim Documents”). Prize may be forfeited if the Prize Claim Documents are not returned within twenty-four (24) hours after mailing to potential winner or if prize notification or Prize is returned as undeliverable. Each of the Winners agree to the Film Companies’ use of his/her user name on deviantART, or otherwise, for promotional purposes in connection with use of the Entrant’s Work as permitted in these Official Rules in any medium without additional compensation to the extent permitted by law.

  8. GENERAL CONDITIONS AND RELEASE:

    This Contest is void where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. This Contest will be governed by the internal laws of the State of California, USA. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the State of California. Any and all disputes, claims and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action and any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees. Under no circumstances will any Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Entrant (or any Entrant’s parent/legal guardian, if such Entrant is deemed a minor in his/her state of residence) hereby waives all right to seek injunctive relief. Sponsor, Film Companies and judges not responsible for late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due, incorrect or misdirected entries, mail or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Sponsor, Film Companies and judges not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Entrant's e-mail account to receive e-mail messages. Sponsor and Film Companies disclaim any liability for damage to any computer system resulting from participation in, or accessing, posting, uploading or downloading information in connection with, this Contest, and reserve the right, in their sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond Sponsor’s reasonable control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In the event of any such cancellation, termination or suspension, a notice will be posted on the Contest Site and the winners will be selected from among all eligible entries received prior to such time. Sponsor reserves the right, in its sole discretion, to disqualify any Entrant from this Contest or any other promotion conducted now or in the future by Sponsor or any of its affiliates if the Entrant's fraud or misconduct adversely affects the integrity of the Contest. By entering this Contest and/or accepting any prize, each Entrant (or any Entrant’s parent/legal guardian, if such Entrant is deemed a minor in his/her state of residence) agrees: [1] to be bound by these Official Rules and Sponsor’s and/or the judges and decisions, which shall be final in all respects; [2] that the entry becomes solely the Sponsor’s property subject to these Official Rules and will not be acknowledged or returned; [3] hereby assigns all right and title in and to the Work to the Film Companies, including the right to modify, edit, publicly display and make derivatives of the Work subject to these Official Rules; [4] to release and hold harmless Sponsor, the Film Companies and their respective parent companies, subsidiaries, affiliates, licensees, agents, advertisers and promotional agencies, and the officers, directors, members, employees and agents of each (collectively the “Releasees”) from any and all liability for claims, injuries, expenses, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in the Contest or any Contest-related activity, any interaction with, or downloading of, computer Contest information; [5] indemnify, defend and hold harmless the Releasees from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an Entrant's participation in the Contest and/or Entrant's acceptance, use or misuse of prize; [6] the Releasees do not make any representation, warranty or guarantee, express or implied, relating to the Contest or prizes; [7] winner’s (or any winner’s parent/legal guardian, if such winner is deemed a minor in his/her state of residence) acceptance of any prize constitutes a grant and assignment to Sponsor and the Film Companies of an unconditional right to use the Work, winner's name, address, voice, likeness, photograph, biographical and prize information, statements about the Contest and/or live and taped performances of interviews for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [8] that the Releasees are not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to: errors in the advertising, Official Rules, selection and announcement of the winners and distribution of the prizes; [9] that the Releasees are not responsible for any inability of any winner to accept or use any prize for any reason; [10] that Sponsor has the right to modify prize award procedures at its sole discretion; and [11] acknowledges that this is a Contest of skill and not a Sweepstakes or other game of chance.

  9. CAUTION:

    ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
