CONTEST BEGINS AT 10:00:00 AM PACIFIC TIME (“PT”) ON NOVEMBER 3, 2015 AND ENDS AT 11:59:59 PM PT ON NOVEMBER 19, 2015 ("PROMOTION PERIOD"). BY ENTERING THE CONTEST ENTRANT AGREES TO THESE OFFICIAL RULES (“RULES”). ALL ENTRY ARTWORK SUBMITTED MAY APPEAR IN THE CONTEST GALLERY AT SPONSOR’S SOLE DISCRETION.

  1. SPONSOR:

    "The Good Dinosaur" Homepage Take Over Contest ("Contest") is sponsored by DeviantArt, Inc. (“Sponsor”).

  2. ELIGIBILITY:

    Entrants must be at least thirteen (13) years of age as of November 3, 2015 to be eligible to enter the Contest and a legal resident of the United States including the District of Columbia and United States military bases wherever located, and a member of www.DeviantArt.com (“Contest Site”) in good standing. Employees of the Sponsor, or any company associated with the production or release of “The Good Dinosaur” (“Film”) and its respective parent company, subsidiaries, affiliated and successor companies; the advertising, promotional and fulfillment agencies, and any other entity associated with the Contest (individually and collectively, the “Entities”); the members of their households and members of their immediate families, are all ineligible to participate in this Contest. Membership to the Contest Site is required to enter the Contest. Membership in the Contest Site is free. No purchase necessary to enter or win. Members of the Contest Site are not automatically entered into the Contest. Contest is void where prohibited by law. An entrant under the age of majority in his/her state of residence must have permission from his/her parent or legal guardian in order to enter. a prize won by a minor in his or her state of residence will be awarded in the name of said minor’s parent or legal guardian.

  3. HOW TO ENTER:

    • During the Promotion Period, Entrant must follow the instructions on the Contest Site and submit the completed entry of an original artwork based on characters in the Film, using the information and the elements and images provided on the Contest Site and illustrating the following theme: The Good Dinosaur creates a world in which a single moment changed everything, as dinosaurs never go extinct and now live side by side with humans. Join Arlo, a young Apatosaurus, and Spot, a human boy, on their journey home as they face their fears and form an unlikely friendship. Create an original piece of art featuring Arlo, Spot, and/or the world of The Good Dinosaur that shows the power of their friendship and their extraordinary spirit for adventure. (“Theme”).

    • Each person that submits an entry into this Contest shall hereinafter be referred to as an "Entrant."

    • The completed original artwork submitted by the Entrant ("Work") may use or reference the images provided at the Contest Site in any two dimensional drawing, painting, digital or visual medium other than photography and must be submitted at the Contest Site as a single JPG or PNG file. Photographs of an entry made in another medium are acceptable.

    • The Work:

      • must be approximately 2,000 pixels in width and 550 pixels in height;

      • will be made available to the public, including without limitation, posting on the internet. Whether or not the entry is published on the internet, Sponsor makes no representation or warranty regarding the confidentiality of the Entry.

      • must be the Entrant's sole original work made for the Contest and may not use stock materials from others, trademarks, or characters other than those from the Film. The Work must be under no restriction, contractual or otherwise, that will prevent Sponsor and/or the Film Companies’ (defined below) use of the Work and each Work must be free of any and all liens, encumbrances and claims of third parties, with the exception of the limited license provided herein. Entrant (or Entrant’s parent/legal guardian if Entrant is deemed a minor in the state of his/her residence) acknowledges, agrees, represents and warrants that, nothing in the Work infringes on any copyrights, confidential information, trade secrets or trademarks belonging to any person or entity other than the Entrant or violates any person's rights of privacy or publicity and that all necessary releases and permissions have been secured from anyone’s likeness appearing in the Work or any person or entity with any rights in or to the Work. Modifying, enhancing or altering a third party’s preexisting work does not qualify as Entrant’s original work.

      • may include licensed brushes and textures as well as original assets from the Entrant's own work and visual elements from the Film.

      • must be in keeping with the image of Sponsor and the companies involved in the production, distribution, and marketing of the Film (“Film Companies”) and may not disparage or place Sponsor and/or the Film Companies in a negative light, as determined in Sponsor’s sole discretion.

      • may not contain material that:

        1. Contains any movement (i.e. GIFs or Cinemagraphs) or audio;

        2. Contains or depicts illicit drugs, hard liquor or alcohol of any kind, tobacco, someone smoking, or someone under the influence of drugs or alcohol;

        3. Violates or infringes another’s rights, including without limitation, privacy, publicity or intellectual property rights, or that constitutes copyright infringement;

        4. Contains material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

        5. Contains any unacceptable clothing or adornments, or displays any commercial/corporate advertising other than that of Sponsor;

        6. Contains indecent or unsafe behavior or situations, profanities or obscenities, including but not limited to nudity, or pornography, or is otherwise inappropriate, indecent, profane, obscene, hateful, tortuous, slanderous or libelous;

        7. References persons or organizations without their written permission other than that of Sponsor;

        8. Disparages any persons or organizations;

        9. Includes threats to any person, place, business, or group, or contains or depicts graphic violence or real world guns (such as firearms and bullets);

        10. Is unlawful, in violation of or contrary to all applicable federal, state, or local laws and regulations;

        11. Does not comply with the terms or conditions or guidelines posted by the Contest Site.

        12. Is otherwise inappropriate, objectionable, or unsuitable for the uses contemplated in these Official Rules, including for presentation in a public forum, as determined by Sponsor in its sole discretion.

        13. Includes any viruses, worms, corrupt files, Trojan horses, or other forms of corruptive code or content that may harm or compromise the Contest Site and/or the proper conduct of the Contest.

        14. uses any watermarks but may contain a signature by the artist provided that the signature is capable of removal at the request of Sponsor if the entry is adapted for use by the Sponsor as a winning entry in accordance with these Official Rules.

      • If found to be in violation of these Rules, Entrant will be disqualified and therefore removed from the Contest Site gallery (“Gallery”). Works will be added to the Gallery at Sponsor’s discretion.

      • Only online entries will be accepted. No hard copies of the entry will be accepted for judging.

      • Note: winning entries may be displayed by Sponsor on the Contest Site and featured on Sponsor’s or Film Companies’ social media accounts. See Section 6 for additional details regarding prizing for this Contest.

      • ENTRIES MUST BE RECEIVED BY 11:59:59 PM PT on November 19, 2015. No illegible, incomplete, forged or altered entries will be accepted. Works will not be returned.

      • Entrants may enter as many Works as they like however duplicate entries are not allowed and may result in the disqualification of Entrant in Sponsor’s sole discretion.

  4. ENTRANT'S RIGHTS:

    • By entering this Contest, Entrant is hereby granted by Film Companies a non-exclusive license to create a derivative work using Film Companies’ copyrighted works (in whole or in part) as required for (but only as required, and only for the purpose of) creating the Work; provided however, that such license shall be conditioned upon Entrant’s assignment of all rights in and to the Work that Entrant creates, to Film Companies. If such rights are not assigned to Film Companies, Entrant’s license to create derivative works using Film Companies’ copyrighted works (in whole or in part) shall be null and void. Entrant agrees to the foregoing grant of rights, consents, agreements and assignments whether or not Entrant’s Work is used by Film Companies as provided in these Rules. Neither Film Companies nor Sponsor will use any original elements found in a Work by Entrant except in connection with the promotion of the Contest, the Film or as a winning entry (whether online, in print, through social media, or otherwise). Notwithstanding the foregoing, Entrant acknowledges and agrees that it is the nature of the Film Companies businesses to create and disseminate works that may be substantially similar to the Work and Entrant will not be entitled to any compensation as a result of Film Companies use of similar works, nor will Entrant seek injunctive or other equitable relief or attempt to in any way enjoin the exploitation or other use of any Film Companies’ works.

      • Entrant will not acquire any ownership or other interest in any and all trademarks, logos copyrights and other intellectual property of the Film Companies including any characters, costumes, devices or other elements and images, or any characters from the Film provided or otherwise nor in any costumes, devices, artwork or elements rendered by Entrant as part of the Work that use any copyrighted or trademarked element of materials owned and licensed by the Film Companies (collectively the "Marks");

      • except as expressly required in these Rules, Entrant may not use the Marks in any manner whatsoever in connection with the Work or otherwise without Film Companies’ express prior written approval;

      • for avoidance of doubt, Entrant may not use any of the Marks or Work for any commercial purpose; including but not limited to directly or indirectly advertising, marketing or promoting goods or services, or in any way associate Film Companies or the Marks with goods or services.

      • Winning entries may be placed on the Contest Site or featured on Sponsor’s and Film Companies’ social media accounts. By entering this Contest, Entrant (or Entrant’s parent/legal guardian if Entrant is deemed a minor in the state of his/her residence) specifically consents to this use and understands that the winning Work may be adapted, altered or modified in any fashion for this use, as determined by Sponsor or the Film Companies in their sole discretion.

      • Entrant (or Entrant’s parent/legal guardian if Entrant is deemed a minor in the state of his/her residence) may not authorize or permit any Work to be used to promote any product or service of any party other than the Film Companies and/or Sponsor, may not sell the Work or receive any payment for the use of the Work and may only use the Work for the purposes of display in a personal portfolio or in connection with his or her account on the Contest Site.

      • Entrant (or Entrant’s parent/legal guardian if Entrant is deemed a minor in the state of his/her residence) acknowledges that the Film Companies have had, and will continue to have, numerous other artists or entrants render artwork based on the Film, and that the Film Companies may freely use any such artwork by others without any obligation or liability to Entrant whatsoever notwithstanding any coincidental similarity between such artwork and the Work.

      • To the extent any element of the Work, such as textures, brushes or other original content made only by the Entrant for the Work can be separated and used when separated without any part of and without any visual reference to the Marks, then Entrant may use and retain such elements.

  5. JUDGING CRITERIA AND SELECTION OF WINNERS:

    There will be twenty-two (22) semi-finalists (“Semi-Finalists”) and three (3) Grand Prize Winners (“Grand Prize Winners”).

    The Semi Finalists and Grand Prize Winners (collectively, “Winners”) will be selected on or about November 23, 2015, from all eligible and qualified entries by full-time DeviantArt staff who are qualified and impartial judges. The Winners will be selected on the basis of (i) effectiveness in presenting the Theme; (ii) overall impact of the Work; and (iii) originality and artistic skill; all in whatever degree the judges believe to be appropriate in reaching a decision. The judges' decisions are final on all matters relating to the Contest. In the event of a tie, the entry/entries with the highest score in "effectiveness in presenting the Theme,” in the judge’s sole discretion, will be chosen as Winners. The Winners will be announced on November 23, 2015 on the Contest Site and thereafter in a message center announcement to all Entrants.

    The Grand Prize Winners will be announced on the Contest Site, one per day, on November 23, 24 and 25, 2015 in home page billboard takeovers and thereafter in a message center announcement to all Entrants.

  6. PRIZES:

    The three (3) Grand Prize Winners will each receive one (1) grand prize pack (each a “Grand Prize”). Each Grand Prize consists of:

    • Two Thousand ($2,000) U.S. dollars (approximate retail value (“ARV”): $2,000);

    • A one-year CORE membership to DeviantArt (ARV: $50); and

    • Entrant's winning Work included in a home page billboard takeover on the Contest Site for one (1) day with the Work linked to the Entrant’s DeviantArt page for the Work and the Entrant’s name linked to his or her profile page on the Contest Site (ARV: $0.00);

      • ARV of each Grand Prize: $2,050

      • ARV of all three (3) Grand Prizes: $6,150

    The twenty-two (22) Semi-Finalists will each receive one (1) semi-finalist prize pack (each a “Semi-Finalist Prize”). Each Semi-Finalist Prize consists of:

    • Fifty ($50.00) U.S. dollars (ARV: $50.00);

    • A three-month CORE membership to DeviantArt (ARV: $15); and

    • Entrant's winning Work included on a Semi-Finalist’s page on the Contest Site and the possibility that the Work will be used in social media posts by Sponsor and Film Companies identifying the Entrant as the artist (ARV: $0.00).

      • ARV of each Semi-Finalist Prize: $65

      • ARV of all Semi-Finalist Prizes: $1,430

    All Prizes will be awarded (assuming sufficient number of entries). No other substitution or transfer of prizes permitted. Sponsor responsible only for prize delivery; not responsible for prize utility, quality or otherwise. All taxes associated with any Prize awarded are solely the responsibility of each prize winner. A Prize cannot be used in conjunction with any other promotion or offer. Prize elements may not be separated. In the event any portion of the Prize cannot be awarded as stated, that portion of the Prize will go unawarded. Costs and expenses associated with Prize acceptance and use not specifically stated herein as being provided are the sole responsibility of the Winners. No interest will be awarded on cash prizes. Prizes are subject to availability, non-transferable, non-negotiable, non-refundable and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute a Prize for one of equal or greater value for any reason. Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the Contest. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

  7. VERIFICATION OF WINNERS AND DELIVERY OF PRIZES:

    In order to be confirmed as a Winner, and without limitation of any other terms herein, the potential winner (or potential winner’s parent/legal guardian if potential winner is deemed a minor in the state of his/her residence) may be requested to provide satisfactory proof, as determined by Sponsor in its sole discretion, that such potential winner is an eligible Entrant, including but not limited to providing a copy of the potential winner’s government-issued identification and/or additional information required by Sponsor in order to verify eligibility and compliance with these Rules. Potential winners (or potential winner’s parent/legal guardian if potential winner is deemed a minor in the state of his/her residence) may be required to sign an affidavit of eligibility and liability release, a written assignment of the Works, and, where permitted, a publicity release prior to their being declared a Winner (collectively, “Prize Claim Documents”). Prize may be forfeited if the Prize Claim Documents are not returned within twenty-four (24) hours after mailing to potential winner or if prize notification or Prize is returned as undeliverable. Each of the Winners (or Winner’s parent/legal guardian if Winner is deemed a minor in the state of his/her residence) agree to the Film Companies’ use of Winner’s user name on the Contest Site, or otherwise, for promotional purposes in connection with use of the Entrant’s Work as permitted in these Rules in any medium without additional compensation to the extent permitted by law.

  8. GENERAL CONDITIONS AND RELEASE:

    This Contest is void where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. This Contest will be governed by the internal laws of the State of California, USA. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the State of California. Any and all disputes, claims and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action and any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees. Under no circumstances will any Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Entrant (or any Entrant’s parent/legal guardian, if such Entrant is deemed a minor in his/her state of residence) hereby waives all right to seek injunctive relief. Sponsor, Film Companies and judges not responsible for late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due, incorrect or misdirected entries, mail or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Sponsor, Film Companies and judges not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Entrant's e-mail account to receive e-mail messages. Sponsor and Film Companies disclaim any liability for damage to any computer system resulting from participation in, or accessing, posting, uploading or downloading information in connection with, this Contest, and reserve the right, in their sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond Sponsor’s reasonable control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In the event of any such cancellation, termination or suspension, a notice will be posted on the Contest Site and the winners will be selected from among all eligible entries received prior to such time. Sponsor reserves the right, in its sole discretion, to disqualify any Entrant from this Contest or any other promotion conducted now or in the future by Sponsor or any of its affiliates if the Entrant's fraud or misconduct adversely affects the integrity of the Contest. By entering this Contest and/or accepting any prize, each Entrant (or any Entrant’s parent/legal guardian, if such Entrant is deemed a minor in his/her state of residence) agrees: [1] to be bound by these Rules and Sponsor’s and/or the judges and decisions, which shall be final in all respects; [2] that the entry becomes solely the Sponsor’s property subject to these Rules and will not be acknowledged or returned; [3] hereby assigns all right and title in and to the Work to the Film Companies, including the right to modify, edit, publicly display and make derivatives of the Work subject to these Rules; [4] to release and hold harmless Sponsor, the Film Companies and their respective parent companies, subsidiaries, affiliates, licensees, agents, advertisers and promotional agencies, and the officers, directors, members, employees and agents of each (collectively the “Releasees”) from any and all liability for claims, injuries, expenses, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in the Contest or any Contest-related activity, any interaction with, or downloading of, computer Contest information; [5] indemnify, defend and hold harmless the Releasees from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an Entrant's participation in the Contest and/or Entrant's acceptance, use or misuse of prize; [6] the Releasees do not make any representation, warranty or guarantee, express or implied, relating to the Contest or prizes; [7] winner’s (or any winner’s parent/legal guardian, if such winner is deemed a minor in his/her state of residence) acceptance of any prize constitutes a grant and assignment to Sponsor and the Film Companies of an unconditional right to use the Work, winner's name, address, voice, likeness, photograph, biographical and prize information, statements about the Contest and/or live and taped performances of interviews for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [8] that the Releasees are not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; [9] that the Releasees are not responsible for any inability of any winner to accept or use any prize for any reason; [10] that Sponsor has the right to modify prize award procedures at its sole discretion; and [11] acknowledges that this is a Contest of skill and not a Sweepstakes or other game of chance.

  9. CAUTION:

    ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
