THE TRAIN YOUR BRAIN CHALLENGE (the “Contest”) BEGINS AT 12:00:00 AM (Los Angeles, CA, time) ON NOVEMBER 5, 2012, AND ENDS AT 11:59:59 PM (Los Angeles, CA, time) ON DECEMBER 3, 2012 (THE “PROMOTION PERIOD”).

1. Sponsor:

The Contest Sponsors are deviantART, Inc., 7095 Hollywood Blvd., #788, Hollywood, CA 90028 and The Art Department, 503 Neches Street, Austin, TX 78701 (“Sponsors”).

2. How To Enter:

Membership to www.deviantart.com (the “Contest Site”) is required to enter the Contest. There is no charge for membership to www.deviantart.com. If Entrant is already a registered member, Entrant is not automatically entered into the Contest. Entrant must be at least 13 years old AND must have a high school diploma or its non-U.S. equivalent as of NOVEMBER 5, 2012, to be eligible to enter the Contest. The term “high school diploma” refers to secondary education programs in the United States typically provided to students in the age range of 13 to 18 years old; although, through a variety of circumstances, an individual who is 14 years old, for example, could complete these studies and receive a high school diploma or its equivalent. No purchase or payment is necessary to win. Contest is void where prohibited by law. You may be prohibited from participating due to age if your place of residence prevents your participation by law.

Entrant must follow the instructions at the Contest Article and submit a qualified completed entry of a work (the “Work”) in one of the categories listed and described immediately below into the gallery designated for that category at the Contest Article:

  • Illustration;
  • Drawing and Painting;
  • Animation;
  • Entertainment 2D;
  • Entertainment 3D;

A “qualified” Work must comply with the applicable Category Assignment for the category set out in Paragraph 3, below, and referenced at the Contest Article.

ENTRIES MUST BE RECEIVED BY 11:59:59 PM (LOS ANGELES, CA, TIME) DECEMBER 3, 2012.

No illegible, incomplete, forged or altered Works will be accepted.

Entrants may enter as many Works as they like in as many categories as they like however duplicate entries are not allowed and Entrant can only win one prize overall.

Only online entries of the Work will be accepted. No hard copies of the Work will be accepted for judging. Do not submit original files or physical copies of the Work.

The Work:

  • may be entirely new for the Contest or existing artwork you have already produced so long as it complies with the applicable Category Assignment in Paragraph 3, below;
  • must be submitted as a single PNG or JPEG file to the Contest Gallery found on the Contest Site and accessible through the Contest Article; and
  • will not be returned.

The Work (i) must be entirely Entrant's original work and may not use stock materials from others although licensed brushes and textures are acceptable; (ii) may not be inappropriate, offensive, libelous or defamatory, pornographic, sexually explicit, unlawful or plagiarized, as determined by Sponsors in their sole discretion; (iii) must not be harassing, abusive, threatening, harmful, vulgar, profane, obscene, excessively violent, racially, ethnically or otherwise objectionable or offensive in any way, as determined by Sponsors in their sole discretion; (iv) may not violate or encourage others to violate any applicable law, statute, ordinance or regulation; (v) may not contain verbal or visual mentions of commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans; (vi) may not include any viruses, worms, corrupt files, Trojan horses, or other forms of corruptive code or content that may harm or compromise the Contest Site and/or the proper conduct of the Contest; (vii) may not use any watermarks but may contain a signature by the artist; and (viii) if found to be in violation of these rules will be disqualified and therefore removed from the Contest Site Galleries.

By submitting the Work, Entrant represents that (i) (s)he has the unrestricted right to submit the Work; (ii) all persons whose name or likeness appears in the Work have unconditionally consented in writing to their appearance in the Work and unconditionally granted Entrant in writing the right to submit the Work subject to these Official Rules, a copy of which consent and grant will be furnished to Sponsors upon request; and (iii) the Work does not defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights, or involve physical harm to any person or animal.

3. CATEGORY ASSIGMENTS

Assignment for Illustration:

  • A Book Cover OR Graphic Novel Page: Submit an image that would be suitable as book cover art or as a page in a graphic novel.
  • The image must include a figure or animal of any sort. If the entry is a graphic novel page at least one panel should include a figure or animal. ("Figures" can be humans, aliens, robots, monsters, mythical creatures, etc.)
  • Subject matter: Any; you can create your own or use an existing story.
    • For example, you may choose to produce a hypothetical version of any well-known book or graphic novel, such as “War of the Worlds,” by H.G. Wells.
  • Content: A new or existing work. PG-13 (must meet the standards for public display or publication) and must not require a mature filter designation on deviantART
  • Proportions: Any
  • Media: Any
  • Format: either vertical or horizontal (horizontal images must be suitable as a wraparound image for book cover art, or as a spread in a graphic novel)

Assignment for Drawing and Painting:

  • Landscape, Figure, Portrait or Still Life: Submit an image that is of a quality and “finished” as to be appropriate to hang in a public place. ("Figures" can be humans, aliens, robots, monsters, mythical creatures, etc.)
  • Subject matter: Any; must be original, no fan art or copies of master works or other works in the public domain or under copyright
  • Content: A new or existing work. PG-13 (must meet the standards for public display or publication) and must not require a mature filter designation on deviantART
  • Proportions: Any
  • Media: Any traditional and/or digital medium but original file must be "hand drawn."
  • Format: Either vertical or horizontal

Assignment for Animation

  • In-Game or Cinematic/Film or .gif Animation: Create a piece of character animation using any style, medium or software of choice. The only limitation is that the animation must tell a story or moment, but not be more than a minute. 
  • Subject matter: Any; must be original, no copies, mash-ups or fan art
  • Content: PG-13 (must be suitable for public display) and must not require a mature filter designation on deviantART
  • Proportions: Can include character, experimental, .gif, creature, particle fx, or any other animation work.
  • Media: Animation can be either 3D or 2D (traditional or digital in any media). Must be submitted as video file or as a .gif. When submitting film, please see FAQ 836
  • Format: Either vertical or horizontal

Assignment for Entertainment 2D

  • Character, Creature, Environment, or Industrial Design: Submit a design in full color or in black-and-white of any of these categories (Character/Creature/Environment/Industrial Design). Think about the originality of the piece, the uniqueness of the design and how well you command the ability to convey the idea. 
  • Subject matter: Any; must be original, no copies or fan art
  • Content: A new or existing work. PG-13 (must meet the standards for public display or publication) and must not require a mature filter designation on deviantART
  • Proportions: Any
  • Media: Any
  • Format: Either vertical or horizontal

Assignment for Entertainment 3D

  • Character, Creature, Environment, or Industrial Design: Submit a quality, well-presented, render of a 3D model or 3D texture of your creation (applied textures) – May also be a model/texture combination. With all the great 3D art out there both commercially and seen on the internet, what do you do that sets you apart from the rest and how well do you present it?
  • Subject matter: Any; must be original, no copies or fan art
  • Content: A new or existing work. PG-13 (must meet the standards for public display or publication) and must not require a mature filter designation on deviantART
  • Proportions: 3D models must include both mesh renders and model renders (untextured). For 3D textures, please include the maps on the same page as the render. If the 3D artist is submitting both, then include all of the requirements for both the model and texture submissions. If the artist is submitting 3D sculpture maquettes, then the submission must include front side and ¾ views in the submission.
  • Media: Any (can be 3D sculpture maquettes, 3D digital models, 3D digital textures). All submissions must be in a single file.
  • Format: Either vertical or horizontal

4. ENTRANT'S RIGHTS

•All Works submitted will remain the exclusive property of Entrant provided that:

  • during the Promotion Period, and for a period of one year thereafter, eligible Works submitted to the Contest may be posted at the Contest Site or otherwise displayed in selections made by Sponsors in any form and media on or off the deviantART site, but only in connection with promotion of the Contest and/or with reference to the Contest;
  • during the ten (10) year period immediately following the Promotion Period (the "Display Period"), Sponsors may (but will not be obligated to) display prize winning Works at their discretion in any form and media in connection with the promotion of their respective businesses;
  • Sponsors may otherwise use the prize winning Works in such manner and upon such terms and conditions as the relevant Entrant may approve in writing (such approval not to be unreasonably withheld, delayed or conditioned);
  • Entrant acknowledges that Sponsors may change, crop or otherwise alter any prize winning Work for the purposes of its use and/or display including the placement of Sponsor’s respective logos and/or company names on the Work; and
  • Entrant may not authorize or permit any prize winning Work to be used to promote any product or service of any party other than Entrant or Sponsors.

5. SELECTION OF WINNERS:

Potential winners will be selected on or about December 10, 2012, from all eligible and qualified entries. The winning Works will be judged on the basis of (i) Creativity, (ii) Successful Use of the Discipline (iii) Following the Assignment (iv) Overall Impact in whatever degree the judges believe to be appropriate in reaching a decision. The judges will all be active faculty members of The Art Department and the names of the judges in each of the five categories are listed in the Contest Article. Works will be judged without regard to Entrants’ race, creed, sex, color, religion, national origin, sexual orientation, pregnancy or parental status or disability. Only one Work per Entrant may be chosen as a winning Work. The judges' decisions are final on all matters relating to the judging of Works. In the event of a tie in any portion of the judging process, the judges themselves will resolve the tie to the appropriate number of ranked winners in the judges’ sole discretion.

6. PRIZES

Each discipline (Illustration, Drawing and Painting, Entertainment 2D, Entertainment 3D, and Animation) will have separate winners for each of the first- through third- place prize packages, selected from the entries received during the Promotion Period in each respective category. Accordingly, within each discipline, there will be one (1) 1st Place Prize Package, ten (10) 2nd Place Prize Packages, and twenty (20) 3rd Place Prize Packages awarded as set out below. You must be over the age of 18 at the time that the prizes are announced in order to win the 1st Place Prize Packages with the exception of the 1st Place Prize Package for Animation

Illustration Prizes

Illustration 1st Place Prize Package: one (1) first place winner will receive

Classes as Prizes:

Each class given to a second or third place prize winner (and the on-line classes given to first place winners) is made available by The Art Department and consists of a minimum of three (3) hours of class time per week, for sixteen (16) weeks. Classes are delivered LIVE ONLINE, and recorded for students who cannot meet the scheduled times. You must have an Internet connection, a personal computer and live in a country or region that does not block content originating from the United States. If a prize winner of an online class is not able to use the class, the prize is forfeited, no substitute prize will be made available and the prize will be awarded to another entrant. Winning Entrants must enroll in prize classes on or before January 15, 2013.

Winners of classes will not be responsible for payment for tuition or generally-applicable and required student fees, but prize excludes, among other things, art supplies, books, and other expenses except as otherwise specified. Any expense item not specifically included is the responsibility of the winner.

Prizes - General

Total ARV of all prizes: $303,895 USD. Odds of winning depend on number of eligible entries received and nature of Work. All prizes will be awarded (assuming sufficient number of entries). The Art Department reserves right to substitute classes of equal or greater value in the event a described class or any portion thereof is unavailable for any reason whatsoever. Any difference between the ARV and actual prize value will not be awarded, refunded, or credited. Limit one (1) win per Entrant. Entrants acknowledge that (i) First Prize value in each discipline respectively is: the scholarship or trip as described and the opportunity for access to and instruction in The Art Department classes described, and (ii) the value of other prizes is the opportunity for access to and instruction in The Art Department classes described; because of a large number of variables including Entrant effort, timeliness, eligibility for enrollment, and other practical and academic concerns, the actual value of the opportunity for access to and instruction in The Art Department classes may vary considerably. Entrants are not eligible to receive payment, including refunds of tuition caused by class cancellation or withdrawal. No other substitution, cash redemptions, refunds, substitutions by Entrant or transfer of prizes permitted. All prize details are at the discretion of The Art Department.

If the 1st Place Prize winner for any category other than Animation is under the age of 18 at the time the prizes are awarded, h/she shall receive the 2nd Place Prize package and the highest ranked 2nd place winner over the age of 18 will be advanced to the 1st Place Prize Package.

If the prize includes travel, the winner will receive round trip economy fare air travel between the nearest major city to the winner’s residence and Kansas City, MO. USA or San Francisco, CA. USA as the case may be. The Art Department will determine flight and accommodation itinerary in its sole discretion; if winner of the Animation 1st Place Prize is a minor, s/he must be accompanied by their parent or legal guardian and winner’s parent/legal guardian must approve all travel arrangements in writing and secure all necessary documentation for travel by the minor; winner (and parent/legal guardian if applicable) must execute liability releases prior to the issuance of travel documents; Sponsors are not responsible for flight or other transportation/accommodation difficulties including cancellation/delay; no refund or compensation will be made in the event or a cancellation or delay in flight; winner (and guest if applicable) are responsible for any visa or passport or other travel documentation requirements at their own cost; Entrant acknowledges that the trip package is for the purpose stated and accordingly, if winning a trip package, will make himself or herself available on the dates required and will not be able to substitute the dates for travel and accommodations presented to the entrant by Sponsors; winner and guest if applicable must travel together on dates designated by The Art Department subject to availability and other restrictions or trip package will be forfeited; travel is subject to the rules and restrictions set forth in these Official Rules and those set forth by the relevant airline carrier and accommodations; any expense and incidental travel costs not specifically included in the package description are the responsibility solely of the winner, including but not limited to meals and incidentals, ground transportation and luggage fees in excess of miscellaneous travel expense amount, passenger tariffs or duties, surcharges, airport fees, service or facility charges, personal charges at lodging, security fees, taxes , and other expenses; Sponsors will not replace any lost, mutilated, or stolen tickets, travel vouchers, or certificates. Accommodations will be described to the winning Entrants in advance of travel and Entrant will be permitted to make alternate choices for accommodations at the Entrant’s sole cost, expense and responsibility.

The Art Department is responsible only for prize delivery. Sponsors are not responsible for prize utility, quality, satisfaction or otherwise. Sponsors do not guarantee: success in enrollment or participation in classes or in The Art Department programs; availability of classes; passing grades; ability to complete classes, earn a degree, transfer class credits, or secure employment or employment opportunities; or quality of instruction. Participation in the prizes and in The Art Department programs is subject to the rules, policies, and requirements of The Art Department as well as applicable law. Taxes and fees, if any, are the sole responsibility of winners.

7. ELIGIBILITY

8. VERIFICATION OF WINNERS AND DELIVERY OF PRIZES

Potential winners over the age of majority in their jurisdiction of residence will be required to sign an affidavit of eligibility and liability release and, where permitted, publicity release. Potential winners who are under the age of majority in their jurisdiction of residence and their parent or legal guardian will be required to sign such an affidavit and releases. Prize may be forfeited if affidavit or releases are not returned within 14 days after mailing to potential winner or if prize notification letter or prize is returned as undeliverable.

PRIVACY POLICY AND TERMS OF USE: If you enter the Contest, Sponsors will not have access to any additional personal information other than the information provided to Sponsors at the time Entrant became a member of deviantART.com. Such information is subject to deviantART’s Privacy Policy and Terms of Use. As a prize winner in the Contest, you may be required to provide additional personal information to confirm your eligibility and to make use of the prizes awarded in this Contest. In addition, each Entrant further acknowledges that if he/she is chosen as a winner, certain of his/her identifying information may be disclosed to third parties as required by law, including, without limitation, on a winner's list.

9. GENERAL

By participating in this Contest, each Entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the Sponsors, The Art Department and/or judges and warrants that s/he is eligible to participate in this Contest. Entrant agrees to return or forfeit any prize award if any representation made by Entrant in these Official Rules is false.

Governing Law

This Contest is void where prohibited or restricted by law and is subject to all applicable federal, state, provincial and local laws and regulations. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants and Sponsors or their agents shall be governed by and construed exclusively in accordance with the laws of the State of California, USA. Entrant agrees that any action at law or in equity arising out of or relating to this Contest, or awarding of the prizes, shall be filed only in the state or federal courts located in the State of California, USA without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws. By participating in the Contest, Entrant agrees that a court within Los Angeles, California, USA will be the exclusive forum for any formal dispute resolution. Entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such actions.

Technical/Communications Failures

Sponsors and/or judges are not responsible for: late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due, incorrect or misdirected entries; mail or communications errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information; technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise; electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Entrant's e-mail account to receive e-mail messages. Sponsors and/or judges disclaim any liability for damage to any computer system resulting from participation in, or accessing, posting, uploading or downloading information in connection with, this Contest, and reserve the right, in their sole discretion, to modify, cancel, terminate or suspend this Contest should any virus, bug, technical failures, unauthorized human intervention (or other causes beyond Sponsors’ reasonable control) corrupt or affect the administration, security, fairness or proper conduct of the Contest. In the event of any such cancellation, termination or suspension, a notice will be posted on the Contest Site and the winners will be selected from among all eligible entries received prior to such time. Sponsors reserve the right, in their sole discretion, to disqualify any Entrant from this Contest or any other promotion conducted now or in the future by Sponsors or any of its affiliates if the Entrant's fraud or misconduct adversely affects the integrity of the Contest.

Governing Law

By accepting a prize, each Entrant agrees to release Sponsors and/or judges and their respective directors, employees, officers, and agents, including without limitation, their advertising and promotion agencies (collectively, “Released Parties”), from any and all claims, liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of the prize or participation in any prize-related activities. In addition, by accepting these Official Rules, Entrant agrees to indemnify and hold harmless the Released Parties against any loss, damage or expense, including court costs and reasonable attorneys' fees, that any of them may suffer as a result of any act or omission of Entrant in connection with this Contest, Entrant's receipt of any prize award, and any representations made by Entrant. ANY CLAIMS, LIABILITY, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THE CONTEST BUT NOT WITH MAKING OR CREATING WORKS, AND IN NO EVENT ATTORNEYS'FEES, PUNITIVE, CONSEQUENTIAL, DIRECT, INDIRECT, OR OTHER DAMAGES.

10. CHANGES

Except as prohibited by law, Sponsors may, in their sole determination, cancel or modify any aspect of the Contest or Official Rules for any reason which Sponsors, in their sole opinion, deem affects the Contest, execution or administration of the Contest (whether tampering, technical or human error, application of new or existing laws/regulations, or other issues).

11. CAUTION

ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
